These terms and conditions apply to purchases made through novasoftshop.com (the “site”), an online marketplace operated by NovaSoft Technologies Pty Ltd, ACN 694 025 379, ABN 31 694 025 379 (“NovaSoft”, “we”, “us”). By placing an order you agree to these terms. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
1. How the marketplace works
NovaSoft Shop is a curated marketplace. The products listed on the site are sourced from third-party suppliers and, when you place an order, are shipped by those suppliers directly to you. Products are not manufactured by NovaSoft, and product names used on the site are descriptive listing titles rather than claims of manufacture. Your contract of sale is with NovaSoft Technologies Pty Ltd: we take your payment, and we are responsible to you for your order, including delivery, returns, refunds and support. Some products on the site are instead listed and sold directly by independent third-party vendors using our marketplace platform (shown with the vendor’s store name on the listing). For those products, your contract of sale is with that vendor, not with NovaSoft, and separate Vendor Terms govern how our vendors operate; section 6 explains how consumer guarantees apply either way.
2. Orders
Your order is an offer to purchase. We accept it when we send an order confirmation email. We may cancel and refund any order before dispatch, including where a product is unavailable from the supplier, where there has been an obvious pricing or listing error, or where we suspect fraud. If we cancel your order we will refund the full amount paid.
3. Prices and payment
All prices are in Australian dollars and include GST where applicable. Prices may change at any time, but changes do not affect orders already placed. Payments are processed by third-party payment providers (including WooPayments and PayPal, where offered); we do not store your full card details. A tax invoice is available on request.
4. Shipping and delivery
We currently sell and deliver only within Australia. Shipping costs are shown at checkout: NovaSoft merch ships free; other Australian orders are $9.90 flat rate or free when the order total is over $100. Because products ship directly from suppliers, including some overseas warehouses, delivery times vary by product and destination, and many orders take between one and three weeks to arrive. These timeframes are estimates, not guarantees. Items in one order may arrive in separate parcels at no extra cost. Risk in the goods passes to you on delivery.
5. Change of mind returns
You may return any item within 30 days of delivery for a refund of the product price, provided it is unused and in its original condition and packaging. Contact [email protected] with your order number for return instructions before sending anything. Return postage for change of mind returns is at your cost and original shipping fees are not refundable. This change of mind policy is in addition to, and does not limit, your rights under the Australian Consumer Law.
6. Faulty items and consumer guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. If an item arrives faulty, damaged or materially different from its listing, contact us and we will arrange a remedy at no cost to you, including return postage where required. This applies whether you bought from our own catalogue or from a marketplace vendor: contact us and we will help arrange or coordinate the remedy, even where the vendor is the seller of record for that item.
7. Product information
Product specifications, compatibility information and images are supplied by the relevant supplier. We take reasonable care in reviewing listings, but colours may render differently on different screens, minor design revisions may occur between production batches, and accessories shown for illustration may not be included. If anything about a listing is unclear, contact us before ordering. If a delivered product materially differs from its listing, your remedies in section 6 apply.
8. Availability
All products are subject to availability from our suppliers. Where an item becomes unavailable after you order, we will contact you to offer a substitute, a backorder or a full refund.
9. Website use
You may not use the site for any unlawful purpose, attempt to interfere with its operation, or scrape or republish its content in bulk. Content on the site, including text and images, may be used only for the purpose of shopping with us.
10. Liability
To the extent permitted by law, and other than the consumer guarantees referred to in section 6, our total liability arising out of or in connection with an order is limited to the amount you paid for that order, and we exclude liability for indirect or consequential loss. Nothing in this section limits any liability that cannot be excluded or limited under applicable law.
11. Privacy
Our collection and handling of your personal information, including sharing delivery details with suppliers to fulfil your order, is described in our Privacy Policy.
12. General
We may update these terms from time to time; the version published at the time you place an order applies to that order. If any part of these terms is found to be unenforceable, the rest continues to apply. These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
